These terms and conditions (the "Terms and Conditions") govern the use of www.onejobs.ca (the "Site"). This Site is owned and operated by VIP TUTOR INC.. This Site is a online recruiting platform.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property

All content published and made available on our Site is the property of VIP TUTOR INC. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Age Restrictions

The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;
  • Violate the rights of other users of our Site;
  • Violate the intellectual property rights of the Site owners or any third party to the Site;
  • Hack into the account of another user of the Site;
  • Act in any way that could be considered fraudulent; or
  • Post any material that may be deemed inappropriate or offensive.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

User Contributions

Users may post the following information on our Site:

  • Videos; and
  • services offered.

By posting publicly on our Site, you agree not to act illegally or violate these Terms and Conditions.

Accounts

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods And Services

These Terms and Conditions govern the sale of goods and services available on our Site.

Though we strive to enforce these Terms of Use, you may be exposed to User Content that is inaccurate or objectionable when you use or access the Site or the Service. We reserve the right, but have no obligation, to monitor the materials posted in the public areas of the Site or the Service or to limit or deny a user’s access to the Service or take other appropriate action if a user violates these Terms of Use or engages in any activity that violates the rights of any person or entity or which we deem unlawful, offensive, abusive, harmful or malicious. The Company shall have the right to remove any material that in its sole opinion violates, or is alleged to violate, the law or this agreement or which might be offensive, or that might violate the rights, harm, or threaten the safety of users or others. Unauthorized use may result in criminal and/or civil prosecution under Federal, State and local law. If you become aware of a misuse of our Service or violation of these Terms of Use, please contact us admin@lyveclass.com.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

User Goods and Services

Our Site allows users to sell goods and services. We do not assume any responsibility for the goods and services users sell on our Site. We cannot guarantee the quality or accuracy of any goods and services sold by users on our Site. However, if we are made aware that a user is violating these Terms and Conditions, we reserve the right to suspend or prohibit the user from selling goods and services on our Site.

Subscriptions

Your subscription does not automatically renew. You will be notified before your next payment is due and must authorize that payment in order for your subscription to continue.

Payments

We accept the following payment methods on our Site:

  • Credit Card;
  • PayPal;
  • Debit; and
  • Direct Debit.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Consumer Protection Law

Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Links to Other Websites

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Website Terms and Conditions Page 4 of 5 Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability

VIP TUTOR INC. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless VIP TUTOR INC. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

User Agreement

1. HOW IT WORKS

1.1 Contracts

With the Contracts Service, a Client can create and send fixed-price or hourly contract proposals to any eligible Freelancer. If Freelancer accepts the proposal, the Client and Freelancer will enter directly into a contract.

1.1.1 Fixed Price Contracts

Once the Contract has been accepted, the Client will place the Contract project Funds ("Funds") in for safekeeping purpose. When the work or a milestone is completed, the Client should inspect and approves the work on a reasonable timely basis. Once the Client approves the work, Escrow will release the Contract Funds to Freelancer in the following week. Once the Funds are released from Escrow, the Contract will end. If Client fails to respond to Freelancer’s submission, funds will be automatically released after 14 days.

1.1.2 Hourly Contracts

Once the Contract has been accepted, the Client will fund a deposit equivalent to the hourly rate multiplied by the weekly hourly limit agreed to between Freelancer and Client. Freelancer and Client agree and authorize to hold the Contract Deposit in escrow through the term of the Hourly Contract. Client agrees to separately fund payments to Freelancer on a weekly basis based on Freelancer’s submission of weekly work report. If Client approves the submitted hours, Escrow will release the Contract Weekly Funds to Freelancer.

1.2 FEES
1.2.1 Freelancer Fees

For any Contract, Freelancer pays a 20% service fee. Freelancer authorizes and instructs to automatically charge and deduct the Contract Payment Fee from the Contract Funds or Contract Hourly Funds. Service fees are the same whether the contracts are hourly or fixed-price.

1.2.2 Client Fees

Clients are charged a 3.5% payment processing and administration fee on each payment made on a Contract. Service fees are the same whether the contracts are hourly or fixed-price.

1.3 ROLE OF AND USER RESPONSIBILITIES

You understand and agree that OneJobs is not a party to any Contract, is not involved in or responsible for any work performed by Freelancers, is not involved in or responsible for any payment made under a Contract, and has no control over any Freelancer or Client. does not have any power or authority to, and does not, determine any eligibility standards for any Contract, select or contract any Freelancer to provide services to a Client, determine or control any term or condition of the Contract or Project, or cause any Freelancer or Client to accept any Contract or perform any Freelancer Services. Escrow provides escrow services, but does not guarantee that Freelancer will be paid.

1.4 ACCOUNTS

Section 1 discusses what you must agree to before using the Site or Site Services and the different types of accounts that can be created on the Site, as detailed below.

1.4.1 REGISTRATION AND ACCEPTANCE

By registering for an account to use the Site or Site Services (an "Account"), by using the Site or Site Services after the Effective Date if you had an Account on the Effective Date, or by clicking to accept the Terms of Service when prompted on the Site, you agree to abide by this Agreement and the other Terms of Service.

To access and use certain portions of the Site and the Site Services, you must register for an Account. Subject to the Site Terms of Use, certain portions of the Site are available to Site Visitors, including those portions before your Account registration is accepted. reserves the right to decline a registration to join or to add an Account of any type (i.e., as a Client or Freelancer), for any lawful reason, including supply and demand, cost to maintain data, or other business considerations.

If you create an Account as an employee or agent on behalf of a company, you represent and warrant that you are authorized to enter into binding contracts, including the Terms of Service, on behalf of yourself and the company. Your privacy is important to and your information will be handled in accordance with our Privacy Policy.

1.4.2 ACCOUNT ELIGIBILITY

OneJobs offers the Site and Site Services for your business purposes only and not for personal, household, or consumer use. To register for an Account or use the Site and Site Services, you must, and hereby represent that you: (a) are an employee or agent of and authorized to act for and bind an independent business (whether it be as a self-employed individual/sole proprietor or as a corporation, limited liability company, or other entity); (b) will use the Site and Site Services for business purposes only; (c) will comply with any licensing, registration, or other requirements with respect to your business, or the business for which you are acting, and the provision of Freelancer Services; and (d) are either a legal entity or an individual who is 18 years or older (or have otherwise reached the age of majority in the jurisdiction in which you conduct business) in each case who can form legally binding contracts.

1.4.3 ACCOUNT PROFILE

To register for an Account to join the Site, you must complete a User profile (“Profile”), which you consent to be shown to other Users and, unless you change your privacy settings, to be shown to the public. You agree to provide true, accurate, and complete information on your Profile and all registration and other forms you access on the Site or provide to us and to update your information to maintain its truthfulness, accuracy, and completeness. You agree not to provide any false or misleading information about your identity or location, your business, your skills, or the services your business provides and to correct any such information that is or becomes false or misleading.

1.4.4 ACCOUNT TYPES

As described in this Section, there are a number of different Account types. Once you register for one Account type, you can add the other Account types under the same username and password. For example, if you already have a Freelancer Account (defined below), you can add a Client Account (defined below) as a separate account type in settings without re-registering. You agree not to have or register for more than one Account without express written permission from us. We reserve the right to revoke the privileges of the Account or access to or use of the Site or Site Services, and those of any and all linked Accounts without warning if, in our sole discretion, false or misleading information has been provided in creating, marketing, or maintaining your Profile or Account.

1.4.5 ACCOUNT PERMISSIONS

You agree not to request or allow another person to create an Account on your behalf, for your use, or for your benefit, except that an authorized employee or agent may create an Account on behalf of your business. By granting other Users permissions under your Account, including as a Team Member or Agency Member, you represent and warrant that: (a) the User is authorized to act on your behalf; and (b) you are fully responsible and liable for the User’s acts and omissions, including for obligations and liabilities relating to making payments and entering into Service Contracts and the Terms of Service. If any such User violates the Terms of Service, it may affect your ability to use the Site and Site Services. Upon closure of an Account, OneJobs may close any or all related Accounts.

1.4.6 IDENTITY AND LOCATION VERIFICATION

When you register for an Account and from time to time thereafter, your Account will be subject to verification, including, but not limited to, validation against third-party databases or the verification of one or more official government or legal documents that confirm your identity, your location, and your ability to act on behalf of your business on OneJobs. You authorize OneJobs, directly or through third parties, to make any inquiries necessary to validate your identity, your location, and confirm your ownership of your email address or financial accounts, subject to applicable law. When requested, you must timely provide us with complete information about yourself and your business, which includes, but is not limited to, providing official government or legal documents. During verification some Account features may be temporarily limited. When a verification is successfully completed, Account features will be restored.

1.4.7 USERNAMES AND PASSWORDS

Each person who uses the Site must register for their own Account. When you register for an Account, you will be asked to choose a username and password for the Account. You are entirely responsible for safeguarding and maintaining the confidentiality of your username and password. You agree not to share your username or password with any person, and, if you are a legal entity who is not a natural person, to only share your username and password with a person who is authorized to use your Account. You authorize OneJobs to assume that any person using the Site with your username and password, either is you or is authorized to act for you. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your Account or any unauthorized access to the password for any Account. You further agree not to use the Account or log in with the username and password of another User of the Site if (a) you are not authorized to use both or (b) the use would violate the Terms of Service.

2. PURPOSE OF ONEJOBS

Section 2 discusses what OneJobs does and does not do when providing the Site and Site Services and some of your responsibilities when using the Site to find or enter into a Service Contract with a Freelancer or Client, as detailed below.

The Site is a marketplace where Clients and Freelancers can identify each other and advertise, buy, and sell Freelancer Services online. Subject to the Terms of Service, OneJobs provides the Site Services to Users, including hosting and maintaining the Site, facilitating the formation of Service Contracts, and assisting Users in resolving disputes which may arise in connection with those Service Contracts. When a User enters a Service Contract, the User uses the Site to invoice and pay any amounts owed under the Service Contract.

2.1 RELATIONSHIP WITH ONEJOBS

OneJobs merely makes the Site and Site Services available to enable Freelancers and Clients to find and transact directly with each other. OneJobs does not introduce Freelancers to Clients, select Projects for Freelancers, or select Freelancers for Clients. Through the Site and Site Services, Freelancers may be notified of Clients that may be seeking the services they offer, and Clients may be notified of Freelancers that may offer the services they seek; at all times, however, Users are responsible for evaluating and determining the suitability of any Project, Client or Freelancer on their own. If Users decide to enter into a Service Contract, the Service Contract is directly between the Users and OneJobs is not a party to that Service Contract.

You acknowledge, agree, and understand that OneJobs is not a party to the relationship or any dealings between Client and Freelancer. Without limitation, Users are solely responsible for: (a) ensuring the accuracy and legality of any User Content; (b) determining the suitability of other Users for a Service Contract (such as any interviews, vetting, background checks, or similar actions); (c) negotiating, agreeing to, and executing any terms or conditions of Service Contracts; (d) performing Freelancer Services; and/or (e) paying for Freelancer Services. You further acknowledge, agree, and understand that you are solely responsible for assessing whether to enter into a Service Contract with another User and for verifying any information about another User. OneJobs does not make any representations about or guarantee the truth or accuracy of any Freelancer’s or Client’s listings or other User Content on the Site; does not verify any feedback or information provided by Users about Freelancers or Clients; and does not perform background checks on or guarantee the work of Freelancers or Clients. You acknowledge, agree, and understand that OneJobs does not, in any way, supervise, direct, control, or evaluate Freelancers or their work and is not responsible for any Project, Project terms or Work Product. OneJobs makes no representations about and does not guarantee, and you agree not to hold OneJobs responsible for, the quality, safety, or legality of Freelancer Services; the qualifications, background, or identities of Users; the ability of Freelancers to deliver Freelancer Services; the ability of Clients to pay for Freelancer Services; User Content and statements or posts made by Users; or the ability or willingness of a Client or Freelancer to actually complete a transaction. While OneJobs may provide certain badges on Freelancer or Client profiles, such badges are not a guarantee or warranty of quality or ability or willingness of the badged Freelancer or Client to complete a Service Contract and is not a guarantee of any kind, including, the quality of Freelancer Services or Client Project.

You also acknowledge, agree, and understand that Freelancers are solely responsible for determining, and have the sole right to determine, which Projects to accept; the time, place, manner, and means of providing any Freelancer Services; the type of services they provide; and the price they charge for their services or how that pricing is determined or set. You further acknowledge, agree, and understand that: (i) you are not an employee of OneJobs, and you are not eligible for any of the rights or benefits of employment (including unemployment and/or workers compensation insurance); (ii) OneJobs will not have any liability or obligations, including under or related to Service Contracts and/or Freelancer Services for any acts or omissions by you or other Users; (iii) OneJobs does not, in any way, supervise, direct, or control any Freelancer or Freelancer Services; does not impose quality standards or a deadline for completion of any Freelancer Services; and does not dictate the performance, methods or process Freelancer uses to perform services; (iv) Freelancer is free to determine when and if to perform Freelancer Services, including the days worked and time periods of work, and OneJobs does not set or have any control over Freelancer’s pricing, work hours, work schedules, or work location, nor is OneJobs involved in any other way in determining the nature and amount of any compensation that may be charged by or paid to Freelancer for a Project; (v) Freelancer will be paid at such times and amounts as agreed with a Client in a given Service Contract, and OneJobs does not, in any way, provide or guarantee Freelancer a regular salary or any minimum, regular payment; (vi) OneJobs does not provide Freelancers with training or any equipment, labor, tools, or materials related to any Service Contract; (vii) OneJobs does not provide the premises at which Freelancers will perform the work; (viii) unless otherwise agreed with their Client, Freelancers may use subcontractors or employees to perform Freelancer Services by delegating work on fixed-price contracts or by agreeing with their Clients to have hourly contracts for Freelancer’s subcontractor(s) or employee(s); and (ix) OneJobs does not provide shipping services for any physical Work Product. If a Freelancer uses subcontractors or employees, Freelancer further agrees and acknowledges that this Section applies to OneJobs’s relationship, if any, with Freelancer’s subcontractors and employees as well and Freelancer is solely responsible for Freelancer’s subcontractors and employees.

2.2 TAXES AND BENEFITS

Freelancer acknowledges and agrees that Freelancer is solely responsible (a) for all tax liability associated with payments received from Freelancer’s Clients and through OneJobs, and that OneJobs will not withhold any taxes from payments to Freelancer; (b) to obtain any liability, health, workers’ compensation, disability, unemployment, or other insurance needed, desired, or required by law, and that Freelancer is not covered by or eligible for any insurance from OneJobs; (c) for determining whether Freelancer is required by applicable law to issue any particular invoices for the Freelancer Fees and for issuing any invoices so required; (d) for determining whether Freelancer is required by applicable law to remit to the appropriate authorities any value added tax or any other taxes or similar charges applicable to the Freelancer Fees and remitting any such taxes or charges to the appropriate authorities, as appropriate; and (e) if outside of the United States, for determining if OneJobs is required by applicable law to withhold any amount of the Freelancer Fees and for notifying OneJobs of any such requirement and indemnifying OneJobs for any requirement to pay any withholding amount to the appropriate authorities (including penalties and interest). In the event of an audit of OneJobs, Freelancer agrees to promptly cooperate with OneJobs and provide copies of Freelancer’s tax returns and other documents as may be reasonably requested for purposes of such audit, including but not limited to records showing Freelancer is engaging in an independent business as represented to OneJobs.

3.DISPUTES AMONG USERS

Clients and Freelancers are responsible for resolving all disputes arising during the term of service among themselves. OneJobs will not be responsible for resolving any disputes.

A. Terms of Service for Job Seekers
1. Job Ads or Job Listings

OneJobs may make available Job Ads advertising employment opportunities and other job-related content, including links to third-party websites (“Job Listings” or “Job Ads”), through OneJobs’s search results or otherwise through the Site. Searching for Job Ads on OneJobs is free for Job Seekers. Job Ads are created and provided by third parties over whom OneJobs exercises no control; you acknowledge and understand that OneJobs has no control over the content of Job Ads, links to or from Job Ads, or any conditions third parties might impose once a Job Seeker has submitted an application or left the Site. For example, some of these third parties may attempt to charge Job Seekers a fee to apply to a particular job, although OneJobs endeavors not to make such Job Ads available on the Site. If you leave the OneJobs Site and choose to enter a third-party website, you accept any terms and conditions imposed by that third-party. Employer websites may have conversion trackers or use APIS and other functionality provided by OneJobs, which informs us that an application has been completed on an Employer site. An Employer who installs such functionality is required under this Agreement to provide any notice, and obtain any prior consent, that may be required by applicable law. However, you acknowledge and agree that OneJobs has no control over such an Employer or its website. You agree to OneJobs’s use of, and receipt of information from, any such conversion tracker functionality. OneJobs has no obligation to screen any Job Ads, or to include any Job Ads, in its search results or other listings, and may exclude or remove any Job Ads from the Site or your search result for any or no reason. You understand and agree that OneJobs has no obligation to present you with any or all Job Ads. We cannot confirm the accuracy or completeness of any Job Ad or other information submitted by any Employer or other user, including the identity of such Employer or other user. OneJobs assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Ads, Company Pages, screener questions and responses, and assessments. Additionally, OneJobs may provide search options to narrow down Job Ads search results by job type categories (i.e. full-time, part-time, freelancer and internship etc.), and such categories are created independently and entirely by OneJobs, and may not directly or accurately reflect the content of the Job Ads. OneJobs may reformat Job Listings so that you may read them more clearly on a mobile phone.

2. Resumes, Profile, and Recommended Jobs

By creating a public profile through the Site (“Profile”), you are requesting and authorizing OneJobs to make available Your Profile to third parties, such as Employers. Applying for such Job Ads does not guarantee job interviews or hiring. Even where OneJobs highlights items or a Job Ad is shared with you, OneJobs assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of Job Ads or highlights.

OneJobs may also automatically send you recommended jobs via the email address you use to create an OneJobs account or apply to a job. OneJobs may determine what these recommended jobs are on the basis of a variety of factors, including but not limited to, any information you input on the Site about yourself (including in Your Profile), searches you run on the Site, jobs you click on, jobs you apply to, or the materials you provide in a job application to an Employer through OneJobs.

3. Applying to Jobs Through OneJobs

When you apply to a job using OneJobs Apply, OneJobs will attempt to send your application to the contact information provided to us by an Employer or their Agent. We cannot guarantee that such messages and applications will be delivered, received, accessed, read or acted upon. OneJobs also does not guarantee that any Employer will receive, be notified about, access, read or respond to any such resume or other application material, or that there will be no mistakes in the transmission or storage of the data. However, OneJobs may alert you when any of the above events occur. Please note that Job Ads may expire between the time you submit your application and from the time it is received. OneJobs has no responsibility for expired Job Ads or for delivering applications prior to a Job Ad’s expiration.

By using OneJobs, you agree that OneJobs is not responsible for the content of the Employer’s job application, messages, screener questions, skills assessments or their format or method of delivery, and that OneJobs does not guarantee receipt of your application by the Employer, or your receipt of messages from the Employer. Please note that OneJobs does not choose the questions asked by Employers or decide the job qualification criteria of Employers. Some questions may be labeled as Optional, indicating only that the application may be submitted to the Employer without providing an answer. OneJobs cannot guarantee that the Employer will consider such an application or make a particular determination with regard to such an application. OneJobs may inform Job Seekers that an Employer’s requirement from a job description does not appear to be present on a resume or application; this information is presented without warranty and OneJobs does not guarantee that updating a resume or application will result in any job offer. OneJobs does not guarantee the identity of an Employer or any individuals working for any Employers, and cautions Job Seekers when applying to jobs. OneJobs cannot make any guarantee regarding health and safety measures in an Employer’s hiring or interviewing process. OneJobs recommends Job Seekers follow personal health and safety best practices as recommended by the World Health Organization or similar institution. OneJobs does not guarantee the validity of a job offer and cautions Job Seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situations. Job Seekers are solely responsible for verifying the accuracy of any Employer or job offer.

OneJobs may send you a notice relating to account security, such as informing you that you may have recently interacted with a compromised account. OneJobs cannot and does not guarantee that such notices will always be sent or received, and you therefore agree that OneJobs bears no responsibility for doing so. OneJobs makes no warranty regarding, and disclaims any liability for, the accuracy, completeness, timeliness, or reliability of such notices.

4. Communications and Other Actions on the Site

When you view, send, store or receive materials (including Job Listings, resumes, messages, applications, questions and responses in applications, and any other information) through or using the Site, OneJobs may, for example, use such materials for data analysis, quality control, or to refine the Site or any other OneJobs product or service (including to provide better search results and other listings for Job Seekers and Employers), whether via automated means or otherwise. When an Employer views, sends, stores or receives materials through or using the Site, OneJobs may inform you about such actions.

You may receive messages, including but not limited to text messages, emails or email notifications corresponding with your or an Employer’s (in the event you applied for a job) activity on or use of the Site, OneJobs Apply, OneJobs Chat, or any other communications service, product, or feature provided on or through the Site. In all cases, such messages or notifications are provided solely as a courtesy, and you should not rely on them. For example, if you accept an interview request, it is your responsibility to follow up with the employer separately to ensure they know your response, do not rely on notifications through OneJobs. OneJobs disclaims all warranties with regards to the transmission or storage of such courtesy notices, does not guarantee their delivery or receipt, and does not guarantee the date or time at which they may be sent. In the event a message being sent is intended for a closed account, these messages will not be deliverable.

OneJobs reserves the right to turn on or enable OneJobs Chat or other communication options for select Employers or Job Listings, in its sole discretion, and to notify you that OneJobs Chat or other communication options are available for a particular job or Employer. For OneJobs Chat, you may access or view your messages by visiting your OneJobs Chat messages dashboard. OneJobs may, in its sole discretion, turn off or disable OneJobs Chat for any Employer or Job Seeker at any time without prior notice. Please note that if you are using OneJobs Chat to communicate with an Employer, OneJobs will deliver your messages as instructed by the Employer.

5. Your Job Seeker Data

As a Job Seeker, if you set Your Profile to public, this means that OneJobs may share all of the aforementioned information about yourself with third-party Employers. If you do not wish to share such information, you may set Your Profile to private. When you make changes to your OneJobs Profile, including, but not limited to, updating, deleting, or changing settings on Your Profile, it may take a few days for the changes to be reflected.

6. Class Action Waiver

By using the Site and in return for the services offered by OneJobs, you acknowledge that OneJobs can only offer you these services under the terms and conditions as presented herein. As partial consideration for your use of the Site and these services, you agree not to sue OneJobs as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class-action lawsuit against OneJobs regarding your use of the Site. Additionally, as a Job Seeker, your use of job search on the Site is at no charge and you acknowledge that part of the price you are paying to use this Site is your acceptance of these terms of service including this Class Action Waiver. If you do not agree to any part of these terms, do not continue your use of the Site.

B. User Agreement for Employers
1. Employer Accounts

When you create an OneJobs account, a Company Page or post job listings advertising employment opportunities and other job-related contents, including links to third-party websites (“Job Listings” or “Job Ads”) on the Site, whether as part of the OneJobs Ads Program or otherwise, you agree that this Agreement, the terms associated with any OneJobs service you are using, and all of OneJobs’s policies, including the OneJobs Privacy Policy and Cookie Policy, apply to you.

As an Employer, your account is for business use and not for personal use. OneJobs is not responsible for and disclaims all liability if your email is used improperly or falsely by a third party. By registering for an OneJobs account, you agree to receive mandatory email updates regarding anomalous activity to your OneJobs account. If you attempt to send an email from a name or email address that is not true, accurate, current or complete, we reserve the right to drop such email, and attempting to send such email is a violation of our terms.

If your OneJobs employer account has a credit card on file to pay for one OneJobs product or service, OneJobs may charge that card for any additional products or services you order.

You agree that OneJobs may send notices to Job Seekers informing them that an Employer account has been compromised, including if such account is associated with you. OneJobs cannot and does not guarantee that such notices will always be sent or received, and you therefore agree that OneJobs bears no responsibility for doing so. OneJobs makes no warranty regarding, and disclaims any liability for, the accuracy, completeness, timeliness, or reliability of such notices.

OneJobs may offer suggestions, recommendations, or information to users that may support or improve their experience on OneJobs Sites. You understand that these offerings are provided as a courtesy and without warranty, and your use of such information is at your sole discretion. As an Employer, you are responsible for your use of the Site and any tools offered therein, including your decisions regarding your job description, the requirements for your job, and whom you interview or hire. OneJobs assumes no responsibility and disclaims all liability for any actions you take based on any information provided by OneJobs.

2. Employer Services

You are responsible for the contents of application form, screener questions or their format, Company Pages that you create, any Job Listings that you post, and any messages that you send through OneJobs Site or otherwise, and agree that OneJobs is not responsible for such content and disclaims all liability for such content, including as to whether such content is legal. You agree that OneJobs may reject or remove any Job Listing, any part of any Company Page, or any questions for Job Seekers for any or no reason. OneJobs further does not guarantee delivery, your receipt of the Job Seeker’s emails or application materials, or that there will be no mistakes in the transmission or storage of the data. You are solely responsible for checking your Employer dashboard to view job applications and other information. Any notifications, such as emails, you may receive about applications or other activities, are provided solely as a courtesy to you and you should not rely on them.

In the event a message being sent is intended for a closed account, these messages will not be deliverable. When using the OneJobs Apply function, OneJobs will attempt to send applications to the contact information provided to OneJobs by you, however, OneJobs has no ability to verify the contact information provided by you. In the event you provide incorrect contact information, it shall be your responsibility to correct, appropriately respond, or take any steps necessary to protect the privacy of such Job Seekers, and you indemnify OneJobs for any damages resulting therefrom.

OneJobs does not verify the identity of any Job Seekers who apply to your job listing, nor does OneJobs know a Job Seeker’s motivation for applying to your job listing, and thus provides no guarantee as to the Job Seeker’s qualifications or interest in your job listing. You agree that OneJobs is presented to you without warranty and OneJobs assumes no responsibility for the communications between you and the Job Seeker, which communications are yours’ and the Job Seekers’ sole responsibility.

You shall indemnify, defend and hold harmless OneJobs, its agents, affiliates, and licensors from any third-party claim or liability (including without limitation reasonable legal fees) arising out of any Company Page created or claimed by you, or any Job Listing or screener questions (or answers thereto) posted by you, or any message sent by you (including any questions for Job Seekers contained in any of the foregoing). OneJobs may make Job Ad analytics data available on a Company Page or elsewhere on the Site, and may provide analytics data regarding your Employer account to anyone at your company at OneJobs’s discretion. To the extent permitted by law, if you have an unpaid or outstanding invoice or account balance for any OneJobs product, OneJobs reserves the right to suspend or terminate your use of that OneJobs product as well as any other OneJobs product, including but not limited to those OneJobs products where you do not have an unpaid invoice or account balance.

When you view, send, store or receive materials (including Job Listings, resumes, and messages) through or using the Site, OneJobs may, for example, use such materials for data analysis, quality control, or to refine the Site or any other OneJobs product or service (including to provide better search results and other listings for Job Seekers and Employers), whether via automated means or otherwise. When you view, send, store or receive materials through or using the Site or when you simply use or visit the Site, OneJobs may inform a Job Seeker that you have taken an action, for example, with regards to a Job Ad, Job Seeker’s Resume, or application such as pausing or closing a Job Ad, opening the Resume or application, viewing the Resume or application, responding to the Resume or application, and making a decision with regards to the application or Job Ad, and you hereby consent to OneJobs taking such actions.

OneJobs, in its sole discretion, may add labels or badges to Employer names or Job Ads, such as, “Responsive Employer” or “Active Employer” or “Hired on OneJobs”. Employers may also request that OneJobs add such labels. OneJobs shall determine the method by which such labels or badges are determined or which Employers qualify. The lack of a label or badge may indicate that OneJobs does not have sufficient data to determine if an Employer qualifies. Some of the data may be provided by the Employer and OneJobs does not guarantee the accuracy of such data.

3. Communication through OneJobs

You may receive messages, emails or email notifications corresponding with your or a Job Seeker’s activity on or use of the Site, OneJobs Chat, or any other communications service, product, or feature provided on or through the Site. In all cases, such messages or notifications are provided solely as a courtesy, and you should not rely on them. For example, if you wish to interview a Job Seeker, it is your responsibility to follow up with the Job Seeker separately to ensure they know about the interview, do not rely on notifications through OneJobs. OneJobs disclaims all warranties with regards to the transmission or storage of such courtesy notices, does not guarantee their delivery or receipt, and does not guarantee the date or time at which they may be sent. In the event a message being sent is intended for a closed account, these messages will not be deliverable.
